1. Definitions

• "Forte Rose" refers to the property, its owners, staff, and authorised representatives.
• "Guest" means any person who stays, dines, or attends an event at Forte Rose.
• "Reservation" includes accommodation bookings, restaurant tables, event packages, or any paid service.
• "Website" means forterose.me and all associated subdomains.

2. Use of our website

You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the site. Prohibited activities include:

• Attempting to gain unauthorised access to our systems.
• Introducing viruses, trojans, or other malicious code.
• Scraping or copying content without permission.
• Misrepresenting your identity or affiliation.

3. Reservations and payments

All reservations (accommodation, dining, events) must be made directly via email, phone, or our contact form. We are not listed on third-party booking platforms (e.g., Booking.com, Expedia).

Payment terms:

• A valid credit card is required to guarantee all accommodation reservations.
• Prepayment of 50% may be required for peak season or group bookings.
• Final payment is due upon check-out, unless otherwise agreed in writing.
• All prices are in EUR and include applicable taxes (VAT, tourist tax) unless stated otherwise.

4. Cancellation and no-show policy

Accommodation:

• Cancellations made more than 14 days before arrival: full refund of deposit (if any).
• Cancellations 7–14 days before arrival: 50% of total stay charged.
• Cancellations less than 7 days before arrival or no-show: 100% of total stay charged.
• Early departure: the full original stay amount applies.

Dining and events: specific cancellation terms will be provided at the time of booking (typically 48–72 hours notice for free cancellation).

5. Guest conduct and property rules

To ensure a safe and enjoyable environment for all, guests agree to:

• Respect quiet hours (23:00 – 08:00).
• Not smoke inside rooms or indoor public areas (designated outdoor smoking areas available).
• Not bring outside guests into the property without prior approval.
• Not host parties or events in rooms without written permission.
• Report any damage caused to Forte Rose property immediately; guests may be charged for repair or replacement.

Forte Rose reserves the right to refuse service, evict guests, or cancel reservations without refund for behaviour that endangers staff, other guests, or the property.

6. Limitation of liability

Forte Rose is not liable for:

• Loss or damage to personal belongings (safety deposit boxes available upon request).
• Injuries arising from swimming, sailing, diving, or other activities – guests participate at their own risk.
• Interruptions due to weather, natural disasters, strikes, or force majeure events.
• Third-party services (e.g., boat rentals, guided tours) – those are subject to separate terms.

Our total liability, to the extent permitted by law, shall not exceed the amount paid by you for the specific reservation.

7. Intellectual property

All content on this website – including text, images, logos, videos, and design – is owned by Forte Rose or used under license. You may not reproduce, distribute, or commercially exploit any content without prior written consent.

8. Privacy and data protection

Our collection and use of personal data is described in our Privacy Policy and Cookie Policy. By using our website or services, you consent to such processing.

9. Governing law and dispute resolution

These Terms are governed by the laws of Montenegro. Any dispute arising from your stay or use of the website shall first be attempted to be resolved amicably. If unresolved, disputes shall be submitted to the competent courts in Herceg Novi, Montenegro.

10. Modifications to these Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes become effective immediately upon posting on this page. Your continued use of the website or subsequent reservations constitutes acceptance of the revised Terms.
